The App and the Site shall collectively be referred to as, the “Services”. This Privacy Policy describes how we may collect, use, or disclose information about you; your choices regarding our use of your information; how we safeguard such information; and how you may contact us regarding our privacy practices. By using the Services, you consent to the collection and use of your personal information as described in this Privacy Policy.
This Privacy Policy does not apply to the privacy practices of third-party websites, applications, or other online services. We encourage you to review all applicable terms, conditions, and privacy policies when using any other websites, applications, or online services.
INFORMATION WE COLLECT
When you use our Services, we may collect certain personal information, which is information that is linked or could reasonably be linked to an identified or identifiable individual (“personal information”).
Information You Provide. You may provide us personal information when you use our Site. For example, you may provide us with your name and email address when you contact us for more information about our products and services. When you register an account with ComfortAI Apps, you may provide personal information such as your full name, postal address, email address, and telephone number. We or your HVAC contractor may use such personal information to assign you an account or customer number.
Information Obtained Automatically. We and our vendors may use cookies, pixels, and other technologies (collectively, “cookies”) to automatically collect information. For example, these cookies may collect your IP address and device identifiers. Cookies allow a website to recognize a visitor’s device, record a visitor’s preferences, track pages that are popular on a website. Most web browsers are set to accept cookies by default, but you usually can change your browser setting to remove or reject cookies. Please note that blocking certain cookies when using the Site may prevent you from using some of the features on our Site. Information Collected Through Your Device. When you download or access our Apps, we may (depending on your device or permission settings) have access to certain information from your device, such as:

We may use location-aware technologies to locate you (as determined by your IP address, GPS, Bluetooth, or Wi-Fi signals, including information about nearby Wi-Fi networks, location beacons, and cell towers) for purposes such as verifying your location or personalizing the Apps to provide you with more location-relevant content or services. Tracking technologies may also be used to enable security features and permit us to detect activity that might violate our terms.
- Device Information and Device ID. We may get information about the device you use, including the model of your device and its operating system, your IP address, device ID or other unique identifier.
- Usage Data. When you use the Apps, we may get certain information such as the time and length of your App use, and other usage data.
- Bluetooth Data. Our ComfortAI products may broadcast an identifying signal wirelessly in order to connect with the Apps.
We may use Software Development Kits (“SDKs”) to collect information when you use the Apps. SDKs are blocks of code that may be installed in a mobile application to understand how visitors interact with the mobile application and collect certain information about the device and network used to access the mobile application, such as the advertising identifier associated with your device.
Information Collected through Interactive Features. You may provide personal information when you use certain interactive features via our Services, which are offered by ComfortAI or a vendor who we engage on our behalf. Your use of these interactive features is voluntary, and we may retain the information that you submit through these features. For example, we may offer an interactive chat feature on our App to assist you with questions and for other customer service purposes. By using these features, you understand that we or our vendors may process the information obtained through the feature to provide the Services.
Information Collected from ComfortAI Products. When you install the ComfortAI products and services, including the box and sensors, on your HVAC system (“ComfortAI Product”), we may collect information about you and your HVAC system. For instance, we collect information about the sensors placed on your HVAC unit, including metrics from those sensors and other runtime data and current temperature and humidity of the HVAC unit. We also collect historical service visit logs when you request an on-site maintenance visit.
HOW WE USE THE INFORMATION WE COLLECT
We may use your personal information for various purposes, including to:
- provide you with information, products, or services that you request;
- authenticate you and enable Services features;
- communicate with you, such as to respond to your questions and tell you about new features or service offerings;
- improve the Services and ComfortAI Products we offer, including running analytics and further training of our AI systems or models;
- market our products and services;
- prevent, identify, investigate, or take any other action with regard to suspected or actual fraudulent or illegal activity or activity that violates our terms or policies; or
- comply with applicable laws, regulations, or legal processes as well as industry standards and our company policies.
Any data collected from your use of the Services or the ComfortAI Products may be linked to you or your user identity. We may combine your personal information with other data we obtain from our services, other users, or other parties. In addition to using your personal information to provide the Services to you, we (or others on our behalf) reserve the right to aggregate or deidentify any personal information collected as you use the Services or other ComfortAI products. We may use the aggregated or deidentified personal information for any other purposes, so long as they are permitted by law. This includes using personal information to train artificial intelligence and machine learning technology, or other similar tools and technology. We may also use your personal information for any other purpose disclosed to you, and with your consent.
DISCLOSURE OF PERSONAL INFORMATION
We may disclose your personal information to our affiliates, partners, HVAC contractors, and other vendors. For example, we may use vendors to help us maintain our Services or ComfortAI Products or to manage activities on our behalf, such as sending emails, maintenance of the Services and ComfortAI Product, customer service, analytics, and online advertising. Interactions with our Services may be monitored and retained for our use, and we may use vendors to collect, store, and analyze information you provide. To the extent we grant third parties access to personal information collected via your mobile device, they are expected to follow privacy practices no less protective than our practices to the extent allowed by applicable law.
In the event of a business transaction, such as if we sell or transfer all or a portion of our business or assets (for example, as part of a merger, reorganization, liquidation, or any other business transaction, including negotiations of such transactions), we reserve the right to disclose any personal information.

CHILDREN’S PRIVACY
Our Services are not intended for or targeted to children under 16 years of age, and we do not knowingly request or collect personal information from any person under 16 years of age. If we learn that we have received information from a child who is under the age of 16, we will delete the information in accordance with applicable law.
DATA SECURITY AND RETENTION
We take commercially reasonable security measures to protect your personal information from loss, theft, misuse, or unauthorized access, disclosure, alteration, or destruction. Although we follow reasonable procedures to safeguard information, the electronic transmission of data is not completely secure and we cannot guarantee the security of your information submitted or otherwise obtained online.
We retain your personal information for no longer than is necessary to achieve the purposes for which the personal information was collected, or as may otherwise be permitted or required under applicable law.
INFORMATION FOR USERS OUTSIDE THE UNITED STATES
Please note that ComfortAI is based in the USA and that personal information submitted via the Services will be transferred to a server in the USA and will be processed by staff operating in the USA. By submitting personal information to ComfortAI, you consent to this transfer, processing and storage. Please be aware that the data protection laws and regulations that apply to your personal information transferred to the USA or other countries may be different from the laws in your country of residence.
YOUR CHOICES
Unsubscribing from Email Marketing. If you no longer wish to receive marketing emails from us, please click on the unsubscribe link in the relevant email or email us at support@comfortai.net. If you opt out of marketing emails, we may still send you administrative emails, such as those related to your account and your requested services.
Deleting Your Account. If you wish to delete your account and associated account data, please email us at support@comfortai.net and request your account deletion. We will inform you when your account deletion has been completed.
Device Settings and Permissions. You can use your mobile device settings to limit mobile tracking technologies and our collection of certain information. Please note that some App features may not function properly if certain permissions are disabled or settings are changed.
With respect to Apps, you can stop all collection of data generated by use of the App by uninstalling the App. Also, you may be able to exercise specific privacy choices, such as enabling or disabling certain features (e.g., location-based services, push notifications, accessing calendar/contacts/photos), by adjusting the permissions in your mobile device and/or the App’s settings. Beware that if GPS precise location services are disabled, other means of establishing or estimating location (e.g., connecting to or proximity to Wi-Fi) may persist.
You may be able to enable or disable location tracing on the App by adjusting the permissions in your App account settings or through your mobile device settings. Note that uninstalling the App or changing the App permissions will not delete your user account or any information we previously collected via the App.
CHANGES TO THIS PRIVACY POLICY
We may update or modify this Privacy Policy from time to time at our discretion. We will indicate any changes to the Privacy Policy by updating the Effective Date. The last updated date will always be provided at the top of this Privacy Policy. Your continued use of the Services after any update will constitute your acceptance of our changes.
